Who Represents Whom?
A real estate agent may represent the buyer, or the seller.
Who is your agent working for? Is your real estate agent working for YOU?
Ask yourself this question, as a prospective buyer of a residence,
second home or investment property here in South Florida:
How could it possibly be beneficial to employ the services of a listing-agent, legally committed to obtain for the seller the highest and best price for their property and to obtain for the seller the best price subject to terms and conditions most suited to the seller's time-frame and other personal requirements?
For the homebuyer, that situation cannot make any kind of sense! |
Buyer-Representation!
It is a pleasure, therefore, to provide our South Florida prospective homebuyers with buyer-broker/buyer-agency representation within the home-search, negotiation and home-acquisition process.
Only the interests of the prospective buyer are represented. Our commitment and loyalty are totally dedicated to our homebuyer customers and clients.
No Conflicting Interests
Any possibility of interest conflict is also substantially reduced or eliminated
by virtue of the fact that, as a buyer-agency residential real estate office,
full-service home-listings are not sought or pursued.
Home-listings may be agreed in order to accommodate the needs of buyer
clients desiring to employ listing-services in order to achieve pre-purchase
sales of existing homes.
When this situation arises, the home is likely to be sold to an outside buyer.
Should a current homebuyer client indicate an interest in the listed home,
the situation is handled by converting to an agreed transactional broker
relationship for the purpose only of that home-showing and any negotiations that ensue. This form of limited representation permits the Florida real estate licensee to facilitate a real estate transaction by assisting both the buyer and the seller.
A very similar situation arises when a listing agreement is entered with a South Florida 'For-Sale-By-Owner'. This would be agreed, in appropriate circumstances, on a fully non-exclusive-listing basis.
Contrast this predominant agency focus on 'homebuyers-only' with the
fact that a great many listing-agents spend so much of their time chasing
'new listings' instead of searching for potentially suitable residences and
properties to meet their prospective homebuyers' needs.
Accountability
Legal accountability is also primarily towards YOU as a homebuyer-client.
As there exists a buyer-representation agreement, we are not, except in regard to the obvious matters of professional ethics and fair-dealing, accountable to the seller. This means that confidential information provided by you - such as price to which you may or may not go, motivation to buy, timing pressures, or such other issues as may apply - all are held in strictest confidence!
The selling/listing agent is under no such constraints as far as prospective buyers are concerned. On the contrary, the selling agent is duty-bound to pass all of this information, together with any similar matters that may have been divulged by the buyer to the 'selling' or 'listing agent' on a misplaced presumption of confidentiality, along to the home-listing principal - the homeseller!
